Vengo siguiendo el tema muy de cerca y la verdad que todavía no me esta quedando completamente claro el tema con Upwork. En mi caso me llegó un mail a principio de este mes pidiendo que complete el nuevo W8BEN-E, y con todo este tema pensaba no completarlo y no usar mas Upwork. No estoy del todo seguro porque me piden completarlo, leí que tienen una validez de 3 años y, o se me venció el que complete hace unos años, o si en su momento solo llene el W8BEN y ahora piden el W8BEN-E.
Aparte como dicen, por que reportarian un W8 de una plataforma de freelance? No está vinculada a ninguna cuenta bancaria ese "formulario", que para variar ni siquiera es el formulario original. Me esta comiendo la cabeza este tema.
El formulario W8BEN-E es la version del formulario W8BEN para empresas.
En las FAQS de upwork dice:
The U.S. Internal Revenue Service requires us to collect your tax classification and tax I.D. numbers. If you do not complete an updated W-8BEN or W-8BEN-E form by December 31, 2022, we will have to withhold taxes from your future earnings on Upwork and send them to the IRS. Due to the recent change in reporting thresholds by the IRS, we need to reconfirm this information.
We only use the form to confirm that you are not a U.S. Person and that we are not required to withhold taxes from your earnings for the IRS. This includes providing this information to the IRS if they request it.

Lo que entiendo es que upwork usa el formulario ante IRS para decir "este chabon no vive en USA, no tenemos que retenerle el 30% de los ingresos". Lo que no entiendo es si le manda esa info al IRS o lo usan ellos para cubrirse y nada mas. Fijense la parte que dice: "This includes providing this information to the IRS if they request it."
IF THEY REQUEST IT. "Si (el IRS) lo requiere". Eso me da a pensar que no mandan el formulario automaticamente al IRS.
